Sexual Harassment Claims Attorneys in Florida The American Psychological Association estimates that 71% of working women have been or will be subjected to sexual harassment during their careers. Most women who are harassed never do anything about it hoping that the perpetrator will stop. However, after several widely publicized cases involving alleged sexual harassment, many women are questioning whether offensive behavior that they have experienced actually constitutes sexual harassment.

Sexual harassment is a form of sex discrimination which is unlawful under the federal civil rights acts of 1964 and 1991. Sexual harassment is also unlawful under the Florida Civil Rights Act of 1992.

What is sexual harassment? A federal agency has defined sexual harassment as unlawful sexual advances, requests for favors and other verbal or physical conduct of a sexual nature. There is sexual harassment when one of the following is present:

  1. Where a term or condition of an individual's employment is that he or she submit to such conduct whether made explicitly or implied.
  2. Where employment decisions affecting an individual's job are based on whether the individual submits to or rejects offensive conduct or
  3. Where such conduct has the purpose or effect of substantially interfering with an individual's work performance or creating an intimidating, hostile or offensive working environment.

The harasser can be a coworker, supervisor or even a subordinate.

The subject of sexual harassment is complicated. It might be helpful to discuss the matter to determine whether the conduct of the alleged harasser constitutes sexual harassment.
