DUI, DWAI, DWI: Different Letters for Same Crime

Many people wonder what the difference is between a DUI (Driving Under the Influence) arrest and a DWAI (Driving While Ability Impaired) arrest. The DWAI acronym is only used in a very few states including Florida, Colorado and New York, and there are not that many differences between a DUI, DWI and DWAI. DWAI offenses, if convicted, tend to carry lesser punishments. In Florida, the acronyms DUI and DWI are most often used.

When someone is arrested in Florida for a DUI, there are really two separate cases that arise: the court case, where a person’s freedom is at stake, and the Florida Department of Highway Safety and Motor Vehicles (FDHMSMV) case.

Because there are so many experienced DUI/DWI attorneys out there, many people arrested for these offenses are later found not guilty or found guilty of lesser charges such as reckless driving or careless operation.
